NCDS provides a full range of Alternative Dispute Resolution (ADR) processes to resolve construction claims, including mediation, arbitration, and a hybrid mediation/arbitration process ("Med-Arb"). Mediation involves an impartial individual whose goal is to assist parties in negotiating a voluntary resolution of their differences. Arbitration is a quasi-judicial process of dispute resolution in which the arbitrator retains the authority to issue a final and binding decision based on the evidence, exhibits, testimony, and briefs presented by the parties. Med-Arb is a combination of the mediation and arbitration process in which the neutral first attempts to resolve the dispute between the parties in mediation. The parties stipulate, however, that if any issues remain unresolved, the neutral is authorized to decide the issue in a written decision. Parties may also choose to utilize different neutrals for the mediation and arbitration portion of the process.

NCDS and our affiliate organizations have resolved over 100,000 construction claims since 1979. NCDS has a national panel of experienced construction and real property dispute settlers with backgrounds in construction and real property including contractors, real estate agents, architects, engineers, home and building inspectors, attorneys and other professionals. Our dispute settlers are located throughout the United States.
